In a recent session of the Indian Parliament, the passage of amendments to The Code on Wages, 2019 ("Code") has ignited a contentious debate among stakeholders regarding its implications for labor rights and regulatory efficacy. The Code, aimed at codifying and amending laws pertaining to wages, bonuses, and remuneration across both organized and unorganized sectors of employment, has drawn scrutiny for its perceived impact on worker protections and industrial relations.
While the government asserts that the amendments seek to streamline labor regulations, enhance enforcement mechanisms, and promote harmonization within the labor law framework, critics, including workers' rights groups and opposition leaders, have raised significant concerns. Chief among these concerns is the contention that the amendments pave the way for a "hire and fire" policy and curtail the right to strike, potentially compromising the fundamental rights of workers.
