According to Section 8 3 of the Representation of Peoples Act 1951, anyone who is convicted of an offense and sentenced to imprisonment for a minimum of two years will be disqualified from the date of the conviction. The Congress leader acknowledges the legality of the court judgment, but suggests that a stay of conviction could be obtained through another court. While the legal process may take time, the leader believes that good governance and decency require patience. Disqualification is based solely on the premise of conviction, and removing this foundation could cause the entire structure to collapse. The leader accuses the BJP or parliamentary authorities of acting quickly, but acknowledges that they may have had no other choice. The Supreme Court previously used the term "post haste speed" in a similar case, but ultimately did not obtain a stay of conviction.
